Brian Fowler has represented clients as both Plaintiffs and Defendants in the Federal District Court for the District of New Jersey and in the New Jersey State Superior Court, including the Law Division, Chancery Division and Special Civil Part. Brian has also represented clients in binding arbitrations before private arbitrators, and has appeared before Administrative Law Judges in New Jersey's Office of Administrative Law. Brian has represented clients in a broad variety of litigated matters, including business ownership disputes, contract disputes, employment termination disputes, fraudulent investments, franchise disputes, real estate matters, estate disputes, property condemnation and many others. Brian Fowler represented three individuals who had lost approximately $450,000.00 invested in an overseas real estate development project. These clients claimed that they had been the victims of fraudulent representations concerning the investment. Following a trial lasting over three weeks, the Court entered an award in favor of Mr. Fowler's clients in an amount of approximately $450,000.00.
Brian also represented a client who had been induced to invest over $200,000.00 in a privately held company that allegedly marketed certain machinery. The complaint alleged that the owners of the business were wrongfully siphoning funds from the business for their own personal use, to the detriment of the business and the investors. A confidential settlement was reached in the case.
Brian also represented a client who was induced here in New Jersey to invest in a fast food franchise business in South Korea. After "investing" $125,000.00 in the business opportunity, the client received no further information regarding the business and no return on his investment. The defendant claimed that he had not defrauded the investor, and that the investment merely failed. Following a week-long trial in the Superior Court of New Jersey, the Court found in favor of Brian's client and entered a judgment requiring the defendant to return the client's entire $125,000.00 investment.
Brian Fowler represented a client who had invested monies with a real estate developer for several property development projects. The Complaint alleged that the developer failed to finish projects in a timely fashion as promised and failed to adequately account to the investor for monies expended on the various projects. Brian was co-counsel for the Plaintiff in a three-week long binding arbitration/trial before a retired Superior Court Judge. The arbitration resulted in an award in excess of one million dollars in favor of Brian's client.
Brian Fowler represented a partner in a complex real estate development dispute in which the partner accused Brian's client of diverting monies from the project for his own personal gain. The partner claimed damages in excess of $800,000.00. A trial in the Law Division of the Superior Court of New Jersey, Bergen County lasted more than three weeks and involved hundreds of exhibits. The Judge ruled in favor of Brian's client and dismissed the Plaintiff Partner's claims in their entirety.
Brian Fowler represented a law firm in an action to recover unpaid fees for a product liability matter in which the law firm had defended a large international Manufacturer. The Manufacturer not only refused to pay the fees, but filed a counterclaim alleging mishandling of its file and overbilling, and seeking a refund of over $60,000.00 in fees already paid. After a one week trial, the jury returned a verdict denying all of the Manufacturer's claims, and awarding the law firm every cent of its unpaid fees.
Brian Fowler represented the owner of a business which was displaced as a result of a Bergen County Town's exercise of its eminent domain power to declare a portion of its downtown as "blighted," so that the area could be opened to redevelopment. As a tenant in one of the condemned buidings, Mr. Fowler's client was entitled only to reimbursement of moving expenses. Mr. Fowler brought an appeal in New Jersey's Administrative Court claiming that the unique nature of the client's business and difficulties relocating required an award of relocation expenses far in excess of the amount offered by the Town. Following a three day hearing before an Administrative Law Judge, the case was settled amicably and confidentially by the Parties.
Brian Fowler negotiated on behalf of a business client a settlement of a lawsuit alleging fraud and breach of contract. The client had sold a business to a purchaser who later claimed that historical sales figures provided to him prior to the sale had been fraudulently inflated to induce him to make the purchase. An arbitrator made a six figure award to the purchaser, but Mr. Fowler succeeded in having the award set aside and the matter scheduled for a new trial in the Superior Court. The case settled before trial for $30,000.00.
Brian Fowler recently represented a single mother and her six-year old son who faced eviction from their home. The home had actually been sold at a sheriff's sale after a mortgage in the name of her ex-husband was foreclosed; all without the knowledge of the client. The ex-husband had been required by the terms of the divorce to pay the mortgage on the property. Following submission of briefs and affidavits by Mr. Fowler and attorneys for the foreclosing Bank and other parties to the lawsuit, the Court granted the extraordinary relief of reversing the sheriff's sale and allowing the client and her young son to remain in their home.
Brian was co-counsel representing a Corporate client in a week long trial in the Superior Court of New Jersey in a case in which a former CEO and shareholder of the Company claimed he had been wrongfully terminated and stripped of his shares of stock in the Company. He claimed damages in excess of one million dollars. The Company had removed the former CEO and shareholder for failing to meet his obligations under the shareholder agreement and for misconduct as CEO. Not only did the Court deny all of the Plaintiff's claims, but the Judge awarded $90,000.00 to the Company for damages resulting from the former CEO's wrongful conduct.
Brian represented a home construction company which re-built a home destroyed by fire. The Homeowner refused to pay the Contractor more than $100,000.00 owed after the construction was completed. The Homeowner then sued in Superior Court alleging poor workmanship, overcharges and violations of New Jersey's Consumer Fraud Act. After a two week jury trial the jury rejected all of the Homeowner's claims and awarded Brian's client every penny it claimed it was still owed on the contract.
