New Jersey's Municipal Land Use Law and local Zoning Ordinances can be complicated, and the applicant is required to meet certain legal burdens in order to obtain relief and/or approvals. Further complicating matters is a doctrine known as res judicata, a legal term which means that once a matter is decided, the same matter can not again be brought before the same tribunal. This could mean that an otherwise worthy application which was lost simply because the applicant failed to comply with certain legal technicalities, may not be brought again, even with the assistance of counsel. Therefore, an applicant should be very careful that he or she fully understands from the outset all that is legally required and necessary for an approval.
